In recent years, the US and the EU have pursued markedly different agendas in the pursuit of board gender diversity. The EU has taken a more pro-active governmental approach of mandated quotas, whereas the US is relying largely on the endogenous mechanism of shareholder diversity proposals. Despite their obvious allure as a means of bringing about rapid change, evidence is mounting that board gender diversity quotas may yield various deleterious side effects; and quotas may not be as successful in their (...) core aim of promoting gender diversity as initial broad statistical measures indicate. In this paper we critique the expanding EU quota regime, and consider US shareholder proposals as an alternative change mechanism for improving gender diversity in corporate boards. As an alternative to quotas, diversity resolutions are often dismissed as ineffective because the vast majority fail to formally pass (with a failure rate close to 95%). However, on closer inspection, this ‘failure’ actually results in success. Contrary to the conventional ‘folk’ wisdom -- in the quest to promote gender diversity on corporate boards, the endogenous (US) mechanism of board diversity proposals has, to date, resulted in similar increases in gender diversity as the exogenous (EU) mechanism of government-mandated gender quotas. Furthermore, the former mechanism is more consistent with recent ‘third-wave’ feminist theory. We conclude with the policy recommendation that, rather than quotas, the EU should focus on removing the regulatory barriers that inhibit shareholder democracy. (shrink)

When William James spoke about belief to the philosophy clubs of Yale and Brown in 1896, he forewarned his audience of the nature of his comments by describing them as a “sermon on justification by faith” (James 13), titling the talk “The Will to Believe.” Although there is disagreement about the substance of James’s remarks, it is fairly innocuous to assert that James thought they were appropriate because of the prevalence of the “logical spirit” of many of those who practiced (...) academic philosophy that led them to the conclusion that religious faith was untenable. Background: Patients often are confronted with the choice to allow cardiopulmonary resuscitation (CPR) should cardiac arrest occur. Typically, informed consent for CPR does not also include detailed discussion about survival rates, possible consequences of survival, and/or potential impacts on functionality post-CPR. Objective: A lack of communication about these issues between providers and patients/families complicates CPR decision-making and highlights the ethical imperative of practice changes that educate patients and families in those deeper and more detailed ways. Design: This review integrates disparate (...) literature on the aftermath of CPR and the ethics implications of CPR decision-making as it relates to and is affected by informed consent and subsequent choices for code status by seriously ill patients and their surrogates/proxies within the hospital setting. Margaret Urban Walker’s moral philosophy provides a framework to view informed consent as a practice of responsibility. Ethical considerations: Given nurses’ communicative skills, ethos of care and advocacy, and expertise in therapeutic relationships, communication around DNAR decision-making might look quite different if institutional norms in education, healthcare, law, and public policy held nurses overtly responsible for informed consent in some greater measure. Findings: Analysis from this perspective shows where changes in informed consent practices are needed and where leverage might be exerted to create change in the direction of deeper and more detailed discussions about CPR survival rates and possible consequences of survival. This paper is based on the linguistic and cultural experiences of three francophone writers: Ahmadou Kourouma (Abidjan, Ivory Coast), Suzanne Dracius (Martinique), and Barry Jean Ancelet (Louisiana, United States). Their testimonies are discussed in the opening section. A reading of Jacques Derrida's Monolingualism of the Other; or, The Prosthesis of Origin, enables us to analyze the experiences of these three writers, “whose relation to the French language is as vexed and varied as Derrida's own Algerian inheritance” (in the words of (...) an anonymous reviewer). It leads, in the next section, to a discussion of the impossibility of absolute monolingualism demanded by “linguistic imperialism,” the multiplicity inherent in any language, and the violence of a language which claims to be unique, while serving some ideology or power. In the last part, I address the double interdict to which Derrida believes education must respond, and the double entitlement for which it is responsible. (shrink)

To better understand risk management and mutual aid among American ranchers, we interviewed and mailed a survey to ranchers in Hidalgo County, New Mexico, and Cochise County, Arizona, focusing on two questions: When do ranchers expect repayment for the help they provide others? What determines ranchers’ degrees of involvement in networks of mutual aid, which they refer to as “neighboring”? When needs arise due to unpredictable events, such as injuries, most ranchers reported not expecting to be paid back for the (...) help they provide. When help is provided for something that follows a known schedule or that can be scheduled, such as branding, most ranchers did expect something in return for the help they provide. This pattern makes sense in light of computational modeling that shows that transfers to those in need without expectations of repayment pool risk more effectively than transfers that create debt. Ranchers reported helping other ranchers more often when they belonged to more religious and civic organizations, when they owned larger ranches, when they relied less on ranch vs. other income, and when they had more relatives in the area. Operators of midsize ranches reported helping other ranchers more frequently than did those on smaller and larger ranches. None of our independent variables predicted how many times ranchers reported receiving help from other ranchers. Although ranch culture in the American West is often characterized by an ethic of individualism and independence, our study suggests that this ethic stands alongside an ethic of mutual aid during times of need. Renal replacement therapy is the indicated treatment for individuals with chronic kidney disease (CKD) to survive. However, not all sick people have access to the same treatment. This study compares renal care in two developing countries with different health systems. Specifically, it explores hemodialysis treatment from the perspective of low‐income individuals. A qualitative, comparative study was performed in Brazil and Mexico. Using purposive sampling, the research was based on open‐ended interviews with nineteen participants with kidney failure undergoing hemodialysis treatment in (...) public hospitals and ten relatives. According to our results, Brazilian participants perceived hemodialysis care as satisfactory because of health personnel courtesy as well as free access to dialysis treatment, prescription drugs, hospitalization and transportation. However, they reported deficiencies in the care they were receiving due to shortages of specialists, prescription drugs, laboratory tests and transportation. Mexican participants, in contrast, highlighted the catastrophic costs of medical care because they had no free access to renal therapy, nor adequate financial resources. Our findings suggest that low‐income Brazilian CKD sufferers experience renal care differently, as they are more satisfied and face less obstacles with hemodialysis compared with those of Mexico. At the request of the Midwest Bioethics Center (MBC), we surveyed nurses' and physicians' attitudes and needs regarding Hospital Ethics Committees (HECs). The primary objective of this research project was to inform the practices and policies of the Ethics Committee Consortium of the Bioethics Center.Four thousand eight hundred and twenty-nine surveys were distributed to the medical and nursing staff of eight Kansas City metropolitan area hospitals. One thousand and fifty-five surveys were returned, representing a response rate of 21%.

Strauss faults Rousseau for an overly indeterminate view of nature, which stems from what Strauss sees as a defect in Rousseau’s understanding of the relationship between philosophy and the requirements of civil society. This article considers these issues in light of Rousseau’s broader rhetorical strategy, and explores Rousseau’s attempt to elucidate the possibility of a modern political philosophy that is distinct from science on the one hand and civic moralizing on the other.

How do pictures represent? In this book Robert Hopkins casts new light on an ancient question by connecting it to issues in the philosophies of mind and perception. He starts by describing several striking features of picturing that demand explanation. These features strongly suggest that our experience of pictures is central to the way they represent, and Hopkins characterizes that experience as one of resemblance in a particular respect. He deals convincingly with the objections traditionally assumed to be (...) fatal to resemblance views, and shows how his own account is uniquely well placed to explain picturing's key features. His discussion engages in detail with issues concerning perception in general, including how to describe phenomena that have long puzzled philosophers and psychologists, and the book concludes with an attempt to see what a proper understanding of picturing can tell us about that deeply mysterious phenomenon, the visual imagination. In R_ousseau on Education, Freedom, and Judgment_, Denise Schaeffer challenges the common view of Rousseau as primarily concerned with conditioning citizens’ passions in order to promote republican virtue and unreflective patriotic attachment to the fatherland. Schaeffer argues that, to the contrary, Rousseau’s central concern is the problem of judgment and how to foster it on both the individual and political level in order to create the conditions for genuine self-rule. Offering a detailed commentary on Rousseau’s major work on education, (...) Emile, and a wide-ranging analysis of the relationship between Emile and several of Rousseau’s other works, Schaeffer explores Rousseau’s understanding of what good judgment is, how it is learned, and why it is central to the achievement and preservation of human freedom. The model of Rousseauian citizenship that emerges from Schaeffer’s analysis is more dynamic and self-critical than is often acknowledged. This book demonstrates the importance of Rousseau’s contribution to our understanding of the faculty of judgment, and, more broadly, invites a critical reevaluation of Rousseau’s understanding of education, citizenship, and both individual and collective freedom. What is sensory imagining and what role does it play in our lives? How does visualizing a castle, running through a tune in one's head, or imagining the taste of fish ice cream relate to perceiving such things, or to remembering them? What are the connections between imagining and agency, and how does it relate to emotion and other affect? The Profile of Imagining offers a theory that answers these and many other questions. It argues that sensory imagining involves the (...) redeployment of resources central to perception, though in a radically different context and to very different effect. The result is a view that explains central features of imagining's phenomenology and functional role, including its capacity to capture what it would be like to perceive its objects, while acknowledging the many and striking differences between imagining and sensing. When reasoning about deontic rules (what one may, should, or should not do in a given set of circumstances), reasoners adopt a violation‐detection strategy, a strategy they do not adopt when reasoning about indicative rules (descriptions of purported state of affairs). I argue that this indicative‐deontic distinction constitutes a primitive in the cognitive architecture. To support this claim, I show that this distinction emerges early in development, is observed regardless of the cultural background of the reasoner, and can be selectively (...) disrupted at the neurological level. I also argue that this distinction emerged as a result of selective pressure favouring the evolution of reasoning strategies that determine survival within dominance hierarchies. (shrink)

Is testimony a legitimate source of aesthetic belief? Can I, for instance, learn that a film is excellent on your say-so? Optimists say yes, pessimists no. But pessimism comes in two forms. One claims that testimony is not a legitimate source of aesthetic belief because it cannot yield aesthetic knowledge. The other accepts that testimony can be a source of aesthetic knowledge, yet insists that some further norm prohibits us from exploiting that resource. I argue that this second form of (...) pessimism has certain advantages over the first. I offer two candidates for the non-epistemic norm that, on this view, stands in the way of our taking aesthetic testimony. And I argue that this form of pessimism meets a challenge to pessimism in general – that of explaining why, if testimony cannot be a legitimate source of aesthetic belief, we can nonetheless rightly rely on the aesthetic recommendations of others. A new research area linked to ethics, virtues, and morality is servant leadership. Scholars are currently seeking publication outlets as critics debate whether this new leadership theory is significantly distinct, viable, and valuable for organizational success. The aim of this study was to identify empirical studies that explored servant leadership theory by engaging a sample population in order to assess and synthesize the mechanisms, outcomes, and impacts of servant leadership. Thus, we sought to provide an evidence-informed answer to how does (...) servant leadership work, and how can we apply it? We conducted a systematic literature review (SLR), a methodology adopted from the medical sciences to synthesize research in a systematic, transparent, and reproducible manner. A disciplined screening process resulted in a final sample population of 39 appropriate studies. The synthesis of these empirical studies revealed: (a) there is no consensus on the definition of servant leadership; (b) servant leadership theory is being investigated across a variety of contexts, cultures, and themes; (c) researchers are using multiple measures to explore servant leadership; and (d) servant leadership is a viable leadership theory that helps organizations and improves the well-being of followers. This study contributes to the development of servant leadership theory and practice. In addition, this study contributes to the methodology for conducting SLRs in the field of management, highlighting an effective method for mapping out thematically, and viewing holistically, new research topics. We conclude by offering suggestions for future research. (shrink)

C'est à la lumière de ces enjeux que se sont trouvés éclairés les grands phénomènes de l'Histoire tels que la construction de l'Europe, les Renaissances et les profondes transformations mentales, culturelles et sociales qu'elles provoquent dans les sociétés d'Occident, l'explosion des hérésies, (des albigeois, des vaudois... ) et leur répression, les guerres saintes (le djihad, les croisades), l'antijudaïsme précurseur de l'antisémitisme, l'inquisition... Poursuivie jusqu'à Saint Louis, l'enquête a confronté l'auteur à trois espaces: l'Orient sunnite et chiite, l'Espagne musulmane et l'Occident chrétien et à plusieurs courants de pensée. Former Newsday writer Denise Flaim chronicles their adventurous tales, detailing just what these brawny bikers, who will stop at nothing within the bounds of the law, can teach us all about respecting the creatures in our midst. Despite the unprecedented freedoms that decolonization has brought for many Black1 people – especially in specific regions of the African Diaspora – freedom and its fulfilment, adequate signs and contested meanings remain a preoccupation within Black cultural discourses and practices. At the same time, while political and cultural nationalisms have led to greater political and civil rights, racism has not been eradicated. Furthermore, the new postcolonial globalizations of capital, people and cultures have destabilized the collective identities that framed twentieth-century struggles (...) for national sovereignty and equal citizenship, without necessarily erasing them. Instead, they remain, no longer securely anchored in their old homogenous appearances, but re-configured through the inner differences and contradictions of gender, sexuality, ethnicity and religion. This article addresses these internal differences and the ways in which they produce new contestations over race, the meaning of Black representation and postcolonial freedom, negotiations that are increasingly traced on the intimate contours of the body and the self, through practices of personal consumption, erotic hedonism and style as key performances of freedom. It achieves this through examining two localized moments in the transnational and diasporic circulation of Jamaican dancehall culture, understood as a privileged public space for the performance of Black identifications and personal freedom. It argues that the eroticized discourses of ethnicity, race and gender found in dancehall culture articulate the dominance of neo-liberal conceptions of freedom at the same time as they express, resist and comment on new cultural hegemonies not reducible to racism or the power of the West; that is how dancehall expresses the new problematizations of postcoloniality. 1Except when quoting other writers, I will capitalise the word Black, in order to recognise Black identity as a historically and politically constituted experience and representational category, and not solely denoting skin colour. Given the many differences among women, can feminist theory even speak in terms of the category "woman?" This is the question that currently dominates feminist theory. Theorists who subscribe to traditional feminism argue that feminism must, for political and philosophic reasons, employ the category "woman." Those who take a poststructuralist approach, however, assert that invoking "woman" is an oppressive tactic that advances an essentialist ideal that is oppressive to women no matter what the content of that ideal. Even a "feminist" (...) understanding of "woman" does violence to difference, they charge. Based on the many different ways in which any abstraction manifests itself concretely, they determine that the abstraction is a myth and reality is in fact radically contingent and discursively constructed; it is an ever-shifting field. We can never claim to "know" woman because to know her is only to know she is not knowable. Knowledge has no connection to any stable "being." ;This branch of feminist theory has gained increasing ascendance; currently, the charge of "essentialism" is almost enough to undermine the legitimacy of any feminist theory, no matter what other merits it may possess. But many feminists are uneasy with poststructuralism's depiction of reality and its implications: the impossibility of knowledge and the impossibility of political discourse which invokes an understanding of truth or the good. Yet neither do these traditional feminists wish to foreclose continued questioning. Some feminists try to combine the insights of poststructuralism, and the preservation of questions, with more traditional understandings of knowledge, the subject and reality. They assert that we must somehow combine both contingency and stability in our understanding of "woman." But they do not fully articulate of how both contingency and stability coexist, or how difference and unity coexist. These issues are addressed at length by Aristotle in his Metaphysics, from which feminists can learn a great deal about these tensions. Aristotle is not "traditional" in the simplistic way that he is often portrayed to be. His understanding of being combines many of the insights claimed by poststructuralism without severing the connection between knowledge and being. (shrink)

Donation after circulatory determination of death (DCDD) is an accepted practice in the United States, but heart procurement under these circumstances has been debated. Although the practice is experiencing a resurgence due to the recently completed trials using ex vivo perfusion systems, interest in thoracoabdominal normothermic regional perfusion (TA-NRP), wherein the organs are reanimated in situ prior to procurement, has raised many ethical questions. We outline practical, ethical, and equity considerations to ensure transplant programs make well-informed decisions about TA-NRP. We (...) present a multidisciplinary analysis of the relevant ethical issues arising from DCDD-NRP heart procurement, including application of the Dead Donor Rule and the Uniform Definition of Death Act, and provide recommendations to facilitate ethical analysis and input from all interested parties. We also recommend informed consent, as distinct from typical “authorization,” for cadaveric organ donation using TA-NRP. (shrink)

It is commonly supposed that evolutionary explanations of cognitive phenomena involve the assumption that the capacities to be explained are both innate and modular. This is understandable: independent selection of a trait requires that it be both heritable and largely decoupled from other `nearby' traits. Cognitive capacities realized as innate modules would certainly satisfy these contraints. A viable evolutionary cognitive psychology, however, requires neither extreme nativism nor modularity, though it is consistent with both. In this paper, we seek to show (...) that rather weak assumptions about innateness and modularity are consistent with evolutionary explanations of cognitive capacities. Evolutionary pressures can affect the degree to which the development of a capacity is canalized by biasing acquisition/ learning in ways that favor development of concepts and capacities that proved adaptive to an organism's ancestors. q 1999 Elsevier Science B.V. Nonhuman animals are widely used in psychological research and the level of suffering and death is high. This is usually said to be justified by appealing to the scientific merit of the research. This article looks at notions of scientific merit, queries whether they are as clear-cut as commonly supposed, and argues that with contemporary conceptions it is too easy for any research to count as meritorious. A tightening of the notion of scientific merit is suggested, providing a ground for (...) rejection of certain psychological research. (shrink)
